Our deliveries, services and offers are made exclusively on the basis of these General Terms and Conditions. The General Terms and Conditions therefore also apply to companies for all future business relations, even if they are not expressly agreed again. The inclusion of a customer's general terms and conditions which contradict our general terms and conditions, will not be taken into account.

The presentation of goods in the online shop does not represent a binding application for the conclusion of a sales contract. It is instead a non-binding invitation to order goods in the online shop.
By clicking the button "Buy" you submit a binding offer to buy (§ 145 BGB "German Civil Code").
After receipt of the purchase offer, you will receive an automatically generated e-mail confirming that we have received your order (confirmation of receipt). This confirmation of receipt does not yet represent an acceptance of your purchase offer. A contract is not yet concluded by the confirmation of receipt.
A sales contract for the goods is only concluded when we expressly declare acceptance of the purchase offer (order confirmation) or when we send the goods to you - without prior express declaration of acceptance.
In addition, a contract is already concluded at the time of the order if the payment is already made when the contract is concluded.
If delivered items have obvious material or manufacturing defects, including transport damage, please make a complaint immediately to us or the UPS employee who delivered the items. Failure to notify us of this complaint, however, has no consequences for your legal claims. For all defects of the purchased goods occurring during the legal warranty period, the legal claims for supplementary performance, for removal of defects/new delivery as well as - if the legal requirements are met - the further claims for reduction or withdrawal as well as compensation for damages, including compensation for the damage instead of performance as well as compensation for your futile expenses, shall apply at your discretion. Insofar as we grant you a seller's guarantee, the details result from the guarantee conditions, which are attached to the respective delivered article. Warranty claims exist without prejudice to the statutory entitlements/rights.
Shipping is free of charge at Nordisk Freizeit GmbH if you buy for more than 150 EUR. Depending on ship to country, the costs vary.
You can pay either with VISA, MasterCard or PayPal.
When paying by credit card, the purchase price at the time of order on your credit card is reserved (authorisation). The actual charge to your credit card account is made at the time we ship the goods to you.
When paying with PayPal, you will be redirected to the website of the online provider PayPal during the order process. In order to be able to pay the invoice amount via PayPal, you must be registered there or first register, authenticate with your access data and confirm the payment order to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. You will receive further information during the ordering process. The payment transaction is carried out automatically by PayPal immediately afterwards.
The goods remain our property until full payment has been received.
All prices include VAT. The current price is the one that is indicated on the GRAND CANYON online shop for the product at the time of ordering.
Nordisk Freizeit GmbH reserves the right to change prices that are incorrectly indicated on the GRAND CANYON online shop. Nordisk Freizeit GmbH also reserves the right to make price changes at any time, as well as changes to the fees and/or other costs stated on the GRAND CANYON online shop.
1. Customer's claims for damages are excluded. Excluded from this are the customer's claims for damages which resulted in the injury of life, body, health or the injury of essential contractual obligations (cardinal obligations) as well as the liability for other damages which are based on an intentional or grossly negligent breach of duty of the provider, his legal representatives or vicarious agents. Material contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract.
2. In the event of a breach of essential contractual obligations, the provider shall only be liable for the foreseeable damage typical for the contract if this was caused by simple negligence, unless the customer's claims for damages are based on injury to life, body or health.
3. The restrictions of paragraphs 1 and 2 also apply in favour of the legal representatives and vicarious agents of the provider if claims are made directly against them.
4. The limitations of liability resulting from paragraphs 1 and 2 shall not apply if the provider has fraudulently concealed the defect or has assumed a guarantee for the quality of the item. The same applies if the provider and the customer have reached an agreement on the quality of the item. The regulations of the German product liability law (Produkthaftungsgesetz) remain unaffected.
If you have placed your order with us before 12 noon on a working day, we will deliver on the next working day. Shipping is free of charge at Nordisk Freizeit GmbH.
Nordisk Freizeit GmbH reserves the right to exclude persons from purchasing through the GRAND CANYON online shop.
Nordisk Freizeit GmbH is under no obligation to deliver goods that are sold out.
If you are already a customer, we will deliver to any desired address in Germany (e.g. your workplace). The invoice will be sent to the account address. Please indicate in your order if the delivery address does not match your home address.
You also have the possibility to have your shipment delivered to a UPS Access Point. Please take identification with you when you pick up your shipment, as it can only be delivered to you personally. You can find the opening hours and further information about your Access Point at https://www.ups.com/dropoff.
(1) Consumers generally have a legal right of withdrawal when concluding a long-distance transaction, about which the provider provides information below in accordance with the legal model. In paragraph (2) there is a model revocation form.

You have the right to revoke this contract within fourteen days without giving reasons.
The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.
In order to exercise your right of revocation, you must inform us (Nordisk Freizeit GmbH, Max-Weber-Strasse 16, D-25451 Quickborn, Germany, Tel. +49 (0) 4106 76770, Fax +49 (0) 4106 767714, E-mail info@nordisk.de) by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to revoke this contract. You may use the attached standard form to submit your notice of cancellation. Use of this form is not compulsory.
Submission of your notice of cancellation before the expiry of the cancellation period will be deemed sufficient for compliance with the terms and conditions of cancellation.
Effects of Cancellation
If you cancel this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of the additional costs arising from the fact that you have chosen a different method of delivery from the standard delivery offered by us at an affordable price), without delay and at the latest within fourteen days of the day on which we receive notification of your cancellation of this contract. We will use the same means of payment as you used for the initial transaction, unless we have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.
We may refuse a refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
The goods are to be returned to us without delay and at the latest within fourteen days of the day you inform us of the cancellation of your contract. This period will be deemed to have been respected if the goods are dispatched before the fourteen day period has expired.
Returning the goods is free of charge, as long as you use our returns label. You will find this return label under the link "Returns Label" below. In the case you do not use this return label, you will be liable to pay the return charges yourself.
You shall only be liable for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary for testing the nature, properties and functioning of the goods.

In all data processing procedures (e.g. collection, processing and transmission) we proceed according to the legal regulations. Your data which is necessary for business transactions, will be stored and passed on to service providers commissioned by us to the extent necessary for order processing.

The contract conclusion will be in German. The purchase order text will not be saved by us and can no longer be called up after completion of the ordering process.
In the event of differences of opinion and legal disputes, the law of the Federal Republic of Germany shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). In the case of transactions involving consumers, this choice of law only applies insofar as the protection that is granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
